TERMS OF SALE AND PURCHASING CONDITIONS

Please read these Terms of Sale prior to purchasing a ticket for any event presented by, arranged by, or sold through the Sydney Fringe Festival.

By purchasing a ticket, you represent that you have read and understood these Terms of Sale and Purchasing Conditions, as well as any additional terms imposed by Ferve (ticketing services agency) or the specific event venue. If you purchase tickets on behalf of others, you undertake to inform them of these Terms.

1. Definitions 

“Event” means a concert, show, or performance part of the Sydney Fringe Festival or sold via Sydney Fringe channels.

“You” means the ticket purchaser or attendee.

“We/Us/The Sydney Fringe” means The Sydney Fringe.

2. Ticket Validity and Purchase 

Tickets for Sydney Fringe Festival are only valid if purchased through The Sydney Fringe (telephone, website, or a Sydney Fringe Box Office) or an authorised agent. Tickets purchased via unauthorised resellers (e.g., Viagogo, eBay, Gumtree) may be fraudulent, and entry may be refused.

Authorised agents include: TodayTix, Tixel, Show Film First, and PromoTix.

3. Ticketing Agent Status 

The Sydney Fringe acts as a ticketing agent for the independent artists, venues, and producers (“Presenters”) who participate in the Festival. While the Sydney Fringe manages the sale of tickets, the contract for the performance is between you and the Presenter.

The Sydney Fringe is not responsible for the artistic content, quality, or specific management of the Event, nor for any injury or loss occurring at a Venue not managed directly by the Sydney Fringe.

4. Fees and Payment 

A non-refundable booking fee of $5.50 (GST inclusive) applies per transaction. The Sydney Fringe accepts Mastercard, Visa, and Amex for phone and online sales. Cash is not accepted.

5. Refunds and Cancellation 

Subject to your rights under the Australian Consumer Law and in accordance with the Live Performance Australia (LPA) Ticketing Code of Practice, tickets are non-refundable except in the event of:

Event cancellation or rescheduling.

A significant change in event location.

Changes in personal circumstances, “change of mind,” or lack of personal enjoyment do not entitle the holder to a refund.

Refunds will be processed to the original method of payment. A breach of venue or event conditions does not entitle you to a refund.

6. Exchanges 

Tickets may be exchanged for a different performance of the same production, subject to availability and price differentials. An exchange fee of $3.00 per ticket applies. Requests must be finalised via the website or email (boxoffice@sydneyfringe.com) at least 72 hours prior to the original performance time.

7. Lost or Stolen Tickets 

The Sydney Fringe reserves the right not to refund or exchange lost or stolen tickets. It is the purchaser’s responsibility to provide an accurate email address. If tickets are not received, you must contact us immediately.

8. Seating and Pricing 

8.1 Allocation: For fixed-seated events, we reserve the right to re-allocate you to a seat of comparable value for operational or safety reasons.

8.2 Dynamic Pricing: Ticket prices may change based on demand without notice. Purchases made prior to a price change are not eligible for a refund of the price difference.

8.3 Event Modifications: Subject to your rights under the Australian Consumer Law, The Sydney Fringe reserves the right to modify or withdraw events, artists, performers, or other programme details. Where a modification constitutes a material change to the Event, you may be entitled to a refund in accordance with Clause 5. The Sydney Fringe website provides the most up-to-date information.

9. Concessions 

Valid proof of concession (Full-Time Student, Pensioner, Senior, Health Care Card, Veteran, or Unemployed) must be available for inspection at the point of sale and/or entry to the venue.

10. Delivery and E-Tickets 

Tickets are issued as E-Tickets via the Sydney Fringe app and email. Sydney Fringe is not responsible for missed communications regarding event changes or cancellations due to incorrect email details or failure to check spam/promotional folders.

11. Donations and Checkout Contributions 

11.1 Checkout Contributions: During the checkout process, you may be presented with an option to add a voluntary donation. Any suggested donation is optional and can be edited or removed from your cart prior to payment.

11.2 Tax Deductibility: Donations of $2.00 or more are tax-deductible. A separate tax receipt will be issued via email.

11.3 Refunds: Donations are non-refundable, even in the event of a ticket refund, except in cases of proven clerical error.

12. Tickets for Promotional Use 

Tickets may not be used for advertising, promotion, or as a prize without prior written consent from The Sydney Fringe.

13. Venue Entry and Latecomer Policy 

13.1 Latecomers: Late arrival may result in non-admission, lockout for specific durations, or forfeiture of your allocated seat due to technical requirements. No refunds are issued for late arrival.

13.2 Recording: Use of professional cameras or recording devices is strictly prohibited. Mobile devices must be silent or off.

13.3 Media Consent: By attending, you consent to being photographed or filmed for promotional, marketing, and archival purposes.

14. Public Health and Contact Tracing 

The Sydney Fringe and its partner Venues operate in accordance with current NSW Health guidelines.

14.1 Compliance: You agree to comply with any health orders in place at the time of the performance.

14.2 Data Disclosure: You grant permission for the Sydney Fringe to disclose your contact information to government departments if formally requested for contact tracing purposes.

15. Content and Age Requirements 

15.1 Classifications: Content may not be suitable for all ages. Check event pages for specific classifications.

15.2 Artistic Independence: Sydney Fringe is an open-access festival. Views expressed by artists do not necessarily reflect those of the Sydney Fringe.

16. Babes in Arms 

Children aged 24 months and under may be admitted free of charge to specific events, provided they do not occupy a seat (must sit on a lap). All children aged 25 months and older must have a valid ticket.

17. Liability, Assumption of Risk and Force Majeure 

17.1 Australian Consumer Law. Nothing in this Clause 17 excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified by agreement. The provisions of this Clause 17 apply only to the extent permitted by law.

17.2 Limitation of Liability. Subject to Clause 17.1, and to the maximum extent permitted by law:

(a) Sydney Fringe’s total aggregate liability to you arising out of or in connection with your purchase of a ticket or attendance at an Event is limited to the amount paid by you for the relevant ticket (excluding booking fees, ticketing fees and donations);

(b) Sydney Fringe is not liable for any indirect, consequential, special or incidental loss or damage, including loss of profit, loss of opportunity, loss of enjoyment, travel and accommodation costs, or loss of expected benefit, however arising; and

(c) Consistent with Clause 3, Sydney Fringe is not liable for the acts, omissions, artistic content, or conduct of any Presenter, Venue, performer, or other third party, except where Sydney Fringe is itself acting as the Presenter.

17.3 Assumption of Risk. You acknowledge that attendance at live performance events involves inherent risks including, without limitation, exposure to loud noise, strobe and other lighting effects, theatrical haze or smoke, audience interaction or participation, and movement in low-light conditions. You attend Events at your own risk and are responsible for taking reasonable care for your own safety and the safety of those in your care.

17.4 Force Majeure. Neither Sydney Fringe nor you will be liable for any failure to perform, or delay in performing, any obligation under these Terms (other than an obligation to pay money already due) to the extent that such failure or delay is caused by a Force Majeure Event.

17.5 Force Majeure Events. A “Force Majeure Event” means any event or circumstance beyond the reasonable control of the affected party, including without limitation: (a) acts of God, natural disasters, fire, flood, storm, earthquake, or extreme weather; (b) epidemics, pandemics, public health emergencies, or any order, direction or restriction of a public health authority; (c) war, invasion, hostilities, terrorism, riot, civil disturbance, or industrial action; (d) failure or interruption of essential utilities, transport, or telecommunications networks; (e) acts, orders, or restrictions of any government, regulator, or public authority; and (f) cancellation or unavailability of a key performer, Presenter, or Venue for reasons beyond Sydney Fringe’s reasonable control.

17.6 Notice and Mitigation. The party affected by a Force Majeure Event must notify the other party as soon as reasonably practicable and use reasonable endeavours to mitigate its effects.

17.7 Effect on Events. Where a Force Majeure Event prevents an Event from proceeding, Sydney Fringe will, where reasonably practicable, reschedule the Event or offer a comparable alternative. Where neither is reasonably practicable, you will be entitled to a refund of the ticket price in accordance with Clause 5.

18. General Provisions 

18.1 Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted or modified by agreement. Where Sydney Fringe is liable to you for a failure to comply with a consumer guarantee in respect of services that are not ordinarily acquired for personal, domestic or household use or consumption, our liability is limited, at our option, to: (a) supplying the services again; or (b) paying the cost of having the services supplied again.

18.2 Privacy: Governed by the Sydney Fringe Privacy Policy at www.sydneyfringe.com.

18.3 Severability: If any part of these terms is found unenforceable, the remainder remains in full effect.

18.4 Governing Law: Governed by the laws of New South Wales, Australia, and the LPA Code of Practice.

19. Goods and Services Tax (GST) 

All prices are inclusive of GST. A party must pay GST on any taxable supply made under this Agreement. Terms used in this clause have the meanings defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

20. Binding Acceptance and Revisions 

The Sydney Fringe reserves the right to modify these Terms of Sale at any time. By proceeding with a purchase or attending an Event after updates are posted, you agree to be bound by the modified Terms. No employee, artist, or volunteer has the authority to waive or vary these terms verbally.
